Terms of Use

1. Acceptance of these terms

These Terms of Use (the "Terms") form a binding agreement between you and Peeled Banana LLC ("Peeled Banana", "we", "us", or "our") governing your access to and use of the granny iOS app, the related Peeled Banana backend services, and peeledbanana.com (together, the "Service").

By downloading, installing, or using granny, or by tapping to accept these Terms, you agree to be bound by them and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

These Terms also serve as the end-user license agreement (EULA) for the app. Where we license the app through the App Store under this custom EULA, the Apple-specific terms in section 15 apply.

2. Eligibility (18+)

granny is for adults only. You must be at least 18 years old to use the Service. The Service is not directed to, and may not be used by, anyone under 18. By using granny you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.

3. What granny is, and what she is not

granny is a dating coach for iPhone with personality and memory. You upload screenshots of your dating-app conversations; a vision model extracts the text; and granny gives you a verdict, flags things she notices, and coaches you in her own voice, remembering you over time.

Important disclaimer: granny gives opinionated coaching and entertainment, not professional advice. She is not a therapist, counselor, lawyer, doctor, or licensed relationship professional, and nothing she says is professional, therapeutic, legal, medical, or relationship-counseling advice.

• granny's reads are opinions, not facts or guarantees.
• We do not guarantee any outcome, including any romantic, social, or personal result.
• Every decision you make based on granny is your own. Use your own judgment, and seek a qualified professional if you need real medical, legal, mental-health, or safety advice.

4. Your content and your responsibility

"Your Content" means the screenshots you choose to upload, the conversation transcripts extracted from them, and anything else you submit to granny, including your edits, notes, and journal entries.

Screenshots you upload contain another person's messages — the person you are talking to (the "match"). That person has not agreed to be analyzed. Because of that, you represent and warrant that:

• You have the right to upload and process Your Content, including the match's messages, and to let our AI providers process them to provide the Service.
• You will not upload content you are legally barred from sharing, and you accept responsibility for what you choose to upload.
• You will comply with applicable laws, including privacy and recording laws that may apply where you and the match are located.

License you grant us: you grant Peeled Banana a limited, non-exclusive, worldwide license to host, transmit, process, and display Your Content solely to operate and provide the Service to you. "Process" here includes the transient forwarding of your screenshots and the extracted transcript text to our AI providers for extraction and coaching, exactly as described in our Privacy Policy. We do not store copies of your conversations, transcripts, or notebook on our servers, and the gateway that forwards content to those providers does not retain conversation content.

You retain ownership of Your Content. This license ends when the content is deleted or your account is closed, except for anything we are required to keep by law.

5. Acceptable use

Because every read and coaching turn uses real, paid AI compute, a weekly fair-use cap applies to AI usage on the Service. The cap is enforced per account; granny is not unlimited. We may adjust the cap to keep the Service sustainable, and we will not deduct fair-use limits in bad faith.

When using the Service, you agree not to:

• Use granny for anything illegal, abusive, harassing, hateful, or threatening, or to stalk, dox, or harm any person, including a match.
• Use granny's outputs to manipulate, deceive, coerce, or otherwise harm another person.
• Reverse engineer, decompile, disassemble, scrape, or attempt to extract source code, prompts, or models from the Service, except where that restriction is prohibited by law.
• Circumvent, disable, or interfere with the fair-use cap, billing, security, or rate limits, or access the Service through automated means not provided by us.
• Upload content you have no right to share, or use the Service to violate anyone's privacy or intellectual-property rights.
• Resell, sublicense, or commercially exploit the Service or its outputs without our written permission.

We may suspend or terminate access that we reasonably believe violates these rules.

6. AI limitations and accuracy

granny is powered by third-party AI models, including OpenAI for vision extraction and Anthropic (Claude) for coaching and chat, and may use other AI providers such as xAI or DeepSeek. AI systems are imperfect.

• Extracted transcripts and granny's coaching may be wrong, incomplete, outdated, or "hallucinated" — confidently stated but inaccurate.
• You should review the extracted transcript (you can edit it in the app) and apply your own judgment before relying on anything granny says.
• granny's reads are opinions and entertainment, and they are not a substitute for professional advice or your own decision-making.

We do not warrant that any AI output is accurate, reliable, or fit for any particular purpose.

7. Subscriptions and billing

granny is offered as an auto-renewing subscription sold through Apple In-App Purchase. Subscription management is handled with the help of our subscription provider (RevenueCat), which receives a user and subscription identifier together with your purchase and transaction data in order to manage your entitlement. The price and billing period are shown to you at the point of purchase, in the app and on the App Store, before you confirm.

• Free trial: a free trial is available and is limited to one per user. If you start a paid subscription, any unused portion of a free trial is forfeited at the time of purchase, as required by Apple.
• Auto-renewal: your subscription automatically renews unless you cancel it at least 24 hours before the end of the current period.
• Billing: your Apple ID is charged for renewal within 24 hours before the end of the current period, at the then-current price for your plan.
• Managing and cancelling: you manage and cancel your subscription in your App Store account settings on your device. Deleting the app does not cancel your subscription.
• Fair use: a weekly fair-use cap applies to AI usage as described in section 5.

Refunds: refunds for App Store purchases are handled by Apple, not by Peeled Banana, under Apple's policies. To request a refund, contact Apple through your App Store account; we cannot process App Store refunds on your behalf.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, Peeled Banana disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that AI outputs will be accurate or reliable, or that the Service will meet your expectations or produce any particular result. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, Peeled Banana and its officers, members, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or relationships, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid Peeled Banana for the Service in the 12 months before the event giving rise to the claim, or (b) twenty US dollars (US$20). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Peeled Banana and its officers, members, employees, and suppliers from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to: (a) Your Content, including the match's messages and your right to upload them; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

11. Termination and "forget me" deletion

You may stop using the Service at any time. To delete your data, use "forget me" in the app. This is real deletion, not cosmetic: it deletes your server-side account and all usage and ledger records, deletes your Sign in with Apple identity, deletes your subscriber record at our subscription provider (RevenueCat), and wipes all on-device granny data. It is durable and irreversible.

Deleting your data through "forget me" does not by itself cancel an active App Store subscription — cancel that in your App Store settings, as described in section 7.

We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination — including content responsibility, disclaimers, limitation of liability, indemnification, and governing law — survive.

12. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the effective date and, where appropriate, give notice in the app. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and, if you wish, use "forget me" to delete your data.

13. Governing law and dispute resolution

These Terms are governed by the laws of [ ___ ], without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in [ ___ ], and you and Peeled Banana consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim elsewhere.

Nothing in these Terms limits any rights you have under the mandatory consumer-protection laws of your place of residence.

15. Apple App Store terms (EULA)

Because granny is licensed through the Apple App Store under this custom EULA, the following terms apply, and you acknowledge and agree to them:

• This agreement is between you and Peeled Banana only, and not with Apple. Peeled Banana, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to furnish any maintenance or support services for the app.
• To the maximum extent permitted by law, Apple has no warranty obligation for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) you paid for the app; beyond that, Apple has no other warranty obligations with respect to the app.
• Peeled Banana, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your use of it, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, claims under consumer-protection or similar laws, and claims that the app infringes a third party's intellectual-property rights.
• In the event of a third-party claim that the app or your use of it infringes that third party's intellectual-property rights, Peeled Banana, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms.
• You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. You agree to comply with applicable third-party terms of agreement when using the app, including the Apple Media Services Terms and any applicable US export laws and sanctions.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
